The Organic Law 1/2025, of January 2, on measures concerning the efficiency of the Public Justice Service, repealed the content of Articles 63 to 67 of Law 14/2013, of September 27, on support for entrepreneurs and their internationalization, which regulated the visa and residence permit for investors. However, the second Transitional Provision of said Organic Law allows for the renewal of visas and permits for investors, in accordance with the regulations in force on the date of granting the initial authorization.

Within this framework, it is the responsibility of the Directorate‑General for Commercial Policy and Economic Security to issue reports for the renewal of the visa or residence permit in the cases provided for in the repealed Article 63.2(c) and 63.3 of Law 14/2013:

• Report on the maintenance of the requirements that justified the issuance of a favourable report for a project of general interest.

• Report when the investment was made by a legal entity domiciled in a territory not considered a tax haven under Spanish law.

Required documents

Investors needing such a report for processing the renewal of a visa or residence permit must submit, together with the corresponding application, documentation proving that the required conditions are still met:

• In the case of business projects of general interest, proof must be provided that at least one of the general interest conditions continues to be met, in accordance with the regulations in force at the time of the initial authorization.

• In the case of investments made through a legal entity, proof must be provided that the foreign applicant directly or indirectly holds the majority of voting rights and the power to appoint or dismiss most members of its administrative body.

If the documentation submitted is insufficient to verify compliance with the required conditions, the Directorate‑General for Commercial Policy and Economic Security may request any additional documents it deems necessary.

• Visa: At Diplomatic Missions and Consular Offices.

• Residence permit: At the Large Companies and Strategic Groups Unit of the Ministry of Inclusion, Social Security and Migration.
